The purpose of this Privacy Statement (hereafter referred to as “Statement”) is to define the processing of your personal data as a user (hereafter referred to as “User”)  of one of the esperity.com websites, including esperity.com, community.esperity.com (also known as patientuniverse.com), education.esperity.com (also know as empowermeapp.com) and health.esperity.com (also know as Esperity Health); hereafter referred to as the “Site”) user according to the definition in the Terms of Use (hereafter referred to as “Terms”). Please refer to the Terms concerning the use of the Site.

The Esperity Private Company with Limited Liability (hereafter referred to as “esperity”) undertakes to comply with the Belgian law of 8 December 1992 concerning the protection of privacy with regard to personal data processing. This law can be consulted on the Privacy Commission website (www.privacycommission.be).

3        WHO IS IN CHARGE OF PROCESSING THE DATA ON THE SITE?

 

esperity is responsible for all processing of personal data on the Site.

4        TO WHOM DOES THIS STATEMENT APPLY?

 

This statement is for people who:

  • Request information about our services;

  • Work with us, or work for the natural or legal persons who work for us;

5        INTERPRETATION AND DEFINITIONS

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

Data processing is a transaction applied to data. For example, collection, recording, organization, storage, adaptation, alteration, retrieval, consultation, use, alignment, combination, blocking, erasure, destruction, disclosure by transmission, dissemination or otherwise making available, etc.

DPO: the data privacy officer (DPO) is the person who monitors whether esperity handles the data with a personal character correctly, according to the General Data Protection Regulation (GDPR).

Entity in charge of data processing is a natural or legal person, unincorporated association, or government with the sole authority to determine the purpose and means of data processing. The entity can make such determinations alone or jointly with others.

Medical twin is a person similar to the User him/herself. The extent and kind of similarity is for the User to decide. For example, medical twins might have the same age or sex; they may even be living in the same city. As soon as Users enter sufficient information about themselves and their condition, esperity will start providing them with twin suggestions based on the information on its database.

Personal data is information pertaining to an identified or identifiable person. A person is considered identifiable if s/he can directly or indirectly be identified, in particular by reference to an identification number, or to one or more specific cultural or socioeconomic factors pertaining to his or her physical, physiological and/or mental attributes.

Personal health data is any personal information on the basis of which one can deduce information about the past, present or future physical or mental health. These data do not have any administrative or accounting components pertaining to treatments or healthcare.

Processing: all operations or parts of operations, whether or not carried out with the help of automated processes and applied to personal data, such as collection, registration, organization, storage, modification or modification, extraction, consultation the use, communication by transmission, dissemination or any other form of provision, connection or link, as well as the locking, erasure or destruction of personal data; in the present declaration the terms «processing», «process», «processed», etc. refer to this definition;

Unstructured data is information that the User generates outside the structure provided by the Site. It typically consists of free text-input the User sends to his contacts or the comments he writes on his or her profile.

 

Account means a unique account created for You to access our Service or parts of our Service.

Application means the software program provided by the Company downloaded by You on any electronic device, named Esperity Health

Business, for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of the processing of Consumers’ personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ personal information, that does business in the State of California.

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Esperity bv, Veldkapelgaarde 30 b 1.30.30.

For the purpose of the GDPR, the Company is the Data Controller.

Consumer, for the purpose of the CCPA (California Consumer Privacy Act), means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

Country refers to: Belgium

Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.

Facebook Fan Page is a public profile named Esperity specifically created by the Company on the Facebook social network, accessible from Facebook.com/esperity

Personal Data is any information that relates to an identified or identifiable individual.

For the purposes for GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.

For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.

Sale, for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s personal information to another business or a third party for monetary or other valuable consideration.

Service refers to the Application or the Website or both.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors.

Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Website refers to Esperity, accessible from http://esperity.com

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Under GDPR (General Data Protection Regulation), You can be referred to as the Data Subject or as the User as you are the individual using the Service.

6        WHAT IS THE LEGAL BASIS FOR PROCESSING PERSONAL DATA UNDER GDPR

We may process Personal Data under the following conditions:

  • Consent: You have given Your consent for processing Personal Data for one or more specific purposes.
  • Performance of a contract: Provision of Personal Data is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof.
  • Legal obligations: Processing Personal Data is necessary for compliance with a legal obligation to which the Company is subject.
  • Vital interests: Processing Personal Data is necessary in order to protect Your vital interests or of another natural person.

8        What data do we collect and how do we use Your Personal Data?

 

What type of data is collected?

There are different types of data being collected: personal data; user data and tracking technology and cookies.

 

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information or other medical profile data that can be used to contact or identify You, or to allow you to optimally use our Services.

 

The main data fields comprise all the information provided in your User account during sign-up and Site use. In particular, they may include the following:

The use of all data provided in these fields should not break any laws or infringe on any rights of third parties. For more information, please refer to the General Conditions.

 

  • Medical profile data:
    • Personal characteristics: in particular, age, sex and date of birth.
    • Physical and ethnic characteristics: in particular, height, weight and ethnicity.
    • Lifestyle habits: in particular, tobacco & alcohol consumption, and physical activity.
    • Health: in particular, type of disease, first diagnosis, past & current treatments, secondary effects, depression, mood, and other characteristics associated with your quality of life or day-to-day surroundings, temperature, etc.
    • Biological data: in particular, tumor markers, blood test results, etc.
    • Subjective data about healthcare variables, such as a rating of how you feel on a scale from 0 to 10
    • Quality of Life data: data related to surveys that measure quality of life
    • Medication data: type of medication and dosage
    • Location: in particular, your geographic zone of residence.
    • All types of other data provided during sign-up or Site use: in particular, what is provided while updating the User profile, using the Site tools or communicating with other Users.

 

Some of these data fields, which are marked with an asterisk (*), are necessary and mandatory to open your User account and to access the Site. The rest of the fields are optional, but you benefit from a better service if/when you complete them.

 

The Site also offers Users data fields similar to those above for them to be used by third parties as caregivers. Completing these fields, caregivers can also sign up as Users on behalf of the respective patients.

 

Whatever their nature or gravity may be, esperity cannot be held liable for any consequences of your making data, e.g., names or photographs, public, and thereby allowing others to identify you or a third party.

esperity protects your data, which are not accessible via search engines.

 

You undertake to enter only data concerning yourself. esperity cannot be held responsible for the registration of third party data.

 

An exception is made in the case of entering the data of a third party under your legal responsibility, e.g., minors or incapacitated adults. You, therefore, take full responsibility for obtaining any consent necessary to enter data concerning a third party, and you undertake to scrupulously respect their rights, including those described herein.

 

You undertake to enter accurate, complete and up-to-date data. You also undertake to update your personal data without delay in the event of a change.

 

You understand that your registration on the Site is equivalent to a written consent to process your personal data, including sensitive data pertaining to factors such as health, ethnicity and lifestyle.

 

 

 

 

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data. This empowerme app also considers answers to quizzes, ratings to articles and feedback on polls as usage data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

9        WHY DO WE USE YOUR PERSONAL DATA

 

Data are processed in order to operate the Site for its intended purpose, which is to enable you to do the following:

  • Registering to the Site, and then using it.
  • Having access to educational content
  • Search for clinical trials
  • Track your health over time
  • Describing your condition and following its evolution; following your treatments and identifying their implications on your life and pathology; identifying other users with whom you want to communicate by allowing them to follow your profile along with their own.
  • Providing the Site and the authorized third parties with information – except for the identification data – about yourself for them to conduct studies, improve treatments, analyze statistics and develop new protocols, therapies, etc. These endeavors can involve the third parties’ wanting to contact you; in such cases, the third party sends the Site a request, which is then relayed to you.
  • Interacting with other Users to exchange and share information and messages with them, and to generate reports based on your health.
  • Sharing personal messages with your medical twins through the activation of the “share” function. Your messages can then be translated into other languages to facilitate communication with other Users all around the world. The translations are automatically made with software in order to ensure confidentiality.
  • Contacting partners of esperity and health professionals.
  • Contacting esperity to receive answers to your questions.
  • Identifying your interests better.
  • Displaying personalized content, possibly with ads, and receiving product or service offers. These ads and offers are customized based on your profile, such that they are the ones most likely to serve your best interests.
  • Receiving updates about new developments on the Site and its activities.
  • Making your data – except for the ones used to identify you – available for scientific research and statistics analyses.

 

In general terms, esperity may use Personal Data for the following purposes:

To provide and maintain our Service, including to monitor the usage of our Service.

To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

To manage Your requests: To attend and manage Your requests to Us.

For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

 

 

10    WITH WHOM DO WE SHARE YOUR DATA

 

We do not share identifiable data with third parties, unless you consent to do so, or in the case that one of the situations described below may occur:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.

All employees are required to respect the confidentiality of all personal data.

 

According to what is described above, your data – except for the ones used for your identification and the ones that are unstructured – may be shared in an aggregated way (meaning your data will be pooled with data from other users)  with third parties without your prior consent. These third parties may be other Users, and if applicable, partners of the Site, medical professionals or pharmaceutical companies.

 

 

Processing your data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

 

 

 

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

11    WHAT ARE YOUR RIGHTS OF ACCESS, RECTIFICATION, DELETION AND OPT-OUT

You can exercise your rights of access and rectification for data concerning yourself by simply connecting to your User account.

 

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

 

You can always check the status of the processed data about yourself by sending us a request. We will be sending you the respective information as soon as possible, after verifying your identity.

You can request the rectification of incorrect, incomplete or out-of-date data.

You can also request the deletion of your account. As stated in the Terms, which you have validated, deleted accounts are no longer visible for other Users, but they are not erased either. esperity is in fact expressly authorized to indefinitely retain all the information accumulated in the account prior to its deletion, with the exception of the identification data, which must either be erased or coded at the discretion of esperity. All unstructured data will, however, be erased during the deletion process.

 

In addition, all the regular communications esperity sends you include information about how you can opt out of receiving them.

 

As a security measure, esperity reserves the right to ask you to verify your identity for all access, rectification, deletion or opt-out requests.

 

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

12    HOW DO WE ENSURE THE SAFETY OF YOUR DATA?

We strive to optimally secure personal data against unauthorized use or leakage. For this, we use physical, organizational, technological, administrative and adequate measures such as, but not limited to:

  • We use well known security and encryption methods to ensure the security of your data transmission.
  • We limit access to the computer system, according to the strict needs of each members of our team in terms of his function.
  • As soon as we can, we proceed to the anonymizing or pseudomizing of your data (depending on the purpose).
